TERMS AND CONDITIONS

1. Scope of Services

Art of Senses offers luxury photography and media services including:
  • Portrait Photoshoots (primarily at Al Bustan Palace, a Ritz-Carlton)
  • Wedding & Pre-Wedding Shoots
  • Event Coverage
  • Commercial & Brand Photography
  • Professional Photo Editing
  • Videography Services
  • Printed Photos, Photo Albums, and Add-ons
  • Prints and albums are optional and may incur additional charges, depending on the package chosen

2. Booking & Payment Terms

  • The full payment is required no later than 14 days before the session
  • Payment methods:
    • In person at the hotel office
    • Secure online payment link (provided upon booking)
  • Bookings are not considered confirmed until the deposit is received
  • Unpaid bookings may be canceled without notice

3. Cancellations, Rescheduling & Refunds

  • No charge for cancellations if no payment has been made
  • If a deposit or full payment has been received:
    • Cancellations within 48 hours of the session may result in forfeiture of all fees paid
    • Rescheduling is allowed once, free of charge, if requested at least 72 hours in advance
  • In case of force majeure (weather, illness), fair rescheduling will be offered
  • If Art of Senses cancels the session, a full refund or reschedule will be provided

4. Delivery of Photos & Products

  • Edited digital photos will be delivered within 3 days via a secure private online gallery.
  • The number of edited images included will depend on the client’s selected package and will be clearly communicated at the time of booking.
  • The gallery link will remain active for 30 days, during which clients must download their images. After the 30-day window, the gallery will be removed from public access, but files will remain securely archived for 12 months. After this period, images may be permanently deleted unless otherwise requested by the client.
  • Same-day printed photos are available and can be provided after the photoshoot session, subject to availability, and must be requested in advance.
  • Clients may choose to purchase additional edited images beyond what is included in their package at an extra cost per image. These costs will be clearly stated in the package options or booking confirmation.

5. Re-Edit Requests

  • Clients have up to 14 days after delivery to request minor re-edits
  • Requests after 14 days may be declined or charged extra
  • Major edits (background replacement, artistic alterations) will be quoted based on complexity

6. Copyright & Usage

  • All images and video content remain the intellectual property of Mohammed Majed Mohammed Mousa / Art of Senses
  • Clients receive personal-use rights (print, share with friends/family, post on personal social media, gifting to family)
  • Commercial usage (marketing, publishing) requires separate licensing

7. Client Responsibilities

Clients agree to:
  • Arrive on time for the session
  • Notify the photographer of any privacy/cultural requirements
  • Arrange access or permissions to shoot locations as needed
  • Supervise children or guests during sessions Select their preferred edited images (if applicable) in a timely manner

8. Liability & Indemnification

  • We are not responsible for:
    • Delays due to weather, client lateness, or venue issues
    • Technical malfunctions or data loss beyond our control
  • In case of total failure, Art of Senses may offer a re-shoot or refund
  • Clients agree to indemnify Art of Senses against claims resulting from misuse of images after delivery

9. Dispute Resolution

  • Disputes will be resolved first through mutual discussion
  • If unresolved, mediation will be sought in Muscat, Oman
  • Failing that, disputes shall be resolved under Omani commercial arbitration law

10. Updates

These policies may be updated from time to time. The latest version will always be available on our official website and will apply to all bookings from the effective date forward.
